Terms of Use – aixy

1. Acceptance of Terms

By downloading, installing, or using the aixy application (the “Application”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Application.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on a device you own or control, strictly in accordance with these Terms. You may not:

• Copy, modify, reverse engineer, or create derivative works of the Application.
• Rent, lease, sell, or sublicense the Application.
• Use the Application for illegal, harmful, or unauthorized purposes.

3. Photo Upload & AI Processing

The Application allows you to upload photos for AI-powered transformations (anime, cartoon, portraits, avatars, fantasy art and similar effects). To protect your privacy:

• No biometric identification or facial recognition is performed.
• We do not retain, resell, or share your photos with third parties.
• Uploaded images are used strictly for generating AI art results.

4. Subscriptions & Payments

• Premium features of the Application may require a subscription or in-app purchase:
• Payments are processed securely via Apple App Store.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You can manage or cancel your subscription in your App Store account settings.
• Refunds are subject to Apple’s policies.

5. Intellectual Property

All rights, title, and interest in the Application, including trademarks, content, and code, are owned by Tunahan Aktay or its licensors. You may not use these without prior written permission.

6. User Conduct

You agree not to misuse the Application. Prohibited uses include:

• Uploading harmful, abusive, or unlawful content.
• Uploading content that violates the rights of others (e.g., copyrighted materials without permission).
• Using the Application to create offensive, harmful, or misleading content.
• Attempting to disrupt or abuse the Application’s services.

In cases of abnormal usage — such as nonstop automated generations intended to overload the system — we reserve the right to impose restrictions on an hourly, weekly, or monthly basis.

7. Disclaimer of Warranties

The Application is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free service, nor do we guarantee the artistic accuracy of AI-generated results.

8. Limitation of Liability

To the maximum extent permitted by law, aixy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of the Application.

9. Termination

We may suspend or terminate your access to the Application at any time if you violate these Terms. Upon termination, you must cease using and delete the Application.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Türkiye, without regard to conflict of law principles. Any disputes shall be resolved in the courts of İstanbul, Türkiye.

11. Changes to Terms

We may update these Terms of Use from time to time. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of the Application after changes means you accept the new Terms.
