Terms of Use – FanKit

1. Acceptance of Terms

By downloading, installing, or using the FanKit application (the “Application”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Application.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on a device you own or control, strictly in accordance with these Terms. You may not:

• Copy, modify, reverse engineer, or create derivative works of the Application.
• Rent, lease, sell, or sublicense the Application.
• Use the Application for illegal, harmful, or unauthorized purposes.

3. Photo Upload & Processing

The Application allows you to upload photos to apply AI-powered football-themed transformations — turning your photo into a stadium fan in your team’s kit, swapping your outfit for a national team jersey, placing you at famous landmarks, and similar filters. To protect your privacy:

• Uploaded photos are processed securely and discarded immediately after the transformation is complete.
• No biometric identification or facial recognition is performed.
• We do not retain, resell, or share your photos with third parties.
• Uploaded images are used strictly to generate the requested transformation.

4. Subscriptions & Payments

• This app offers an auto-renewing subscription to unlock unlimited transformations and all countries and filters:
• Payments are processed securely via the Apple App Store.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You can manage or cancel your subscription in your App Store account settings.
• Refunds are subject to Apple’s policies.

5. Intellectual Property

All rights, title, and interest in the Application, including trademarks, content, and code, are owned by Tunahan Aktay or its licensors. You may not use these without prior written permission. Country names, flags, and colors are used for descriptive, non-affiliated fan purposes only; the Application is not affiliated with, endorsed by, or sponsored by any football federation, league, or tournament organizer.

6. User Conduct

You agree not to misuse the Application. Prohibited uses include:

• Uploading harmful, abusive, or unlawful content.
• Uploading photos of other people without their consent.
• Disrupting the functionality of the Application.
• Violating applicable laws or third-party rights.

We reserve the right to impose restrictions in cases of abnormal or abusive usage (e.g., nonstop automated photo submissions intended to overload the system).

7. Disclaimer of Warranties

The Application is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free service. If you use the Application outside of a Wi-Fi area, your mobile provider’s terms still apply and you may incur data or roaming charges. It is your responsibility to manage these costs.

8. Limitation of Liability

To the maximum extent permitted by law, FanKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of the Application.

9. Termination

We may suspend or terminate your access to the Application at any time if you violate these Terms. Upon termination, you must cease using and delete the Application.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Türkiye, without regard to conflict of law principles. Any disputes shall be resolved in the courts of İstanbul, Türkiye.

11. Changes to Terms

We may update these Terms of Use from time to time. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of the Application after changes means you accept the new Terms.
