Terms of Use – FOTU: AI Headshot Generator

1. Acceptance of Terms

By downloading, installing, or using the FOTU application (the “Application”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Application.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on a device you own or control, strictly in accordance with these Terms. You may not:

• Copy, modify, reverse engineer, or create derivative works of the Application.
• Rent, lease, sell, or sublicense the Application.
• Use the Application for illegal, harmful, or unauthorized purposes.

3. Photo Upload & Processing

The Application allows you to upload a photo and turn it into a professional headshot or portrait (for example LinkedIn, passport, dating, corporate, profession, black and white, color and yearbook styles) using AI-powered technology. To protect your privacy:

• Uploaded photos are processed securely and deleted within 24 hours.
• No biometric identification or facial recognition is performed.
• We do not retain, resell, or share your photos with third parties.
• Uploaded images are used strictly to create the headshot style you select.
• Headshots you create are kept only on your device in the Application’s history. You can delete them at any time, and deleting the Application removes them.

4. Your Photos and Generated Headshots

• Only upload photos of yourself, or of people who have given you permission to do so.
• You keep your rights to the photos you upload. You may use the headshots you create for personal and professional purposes, such as your profile pictures, CV or website.
• Generated headshots are created by AI and may differ from reality in details such as clothing, background, lighting or expression. Please review each result before you use it.
• Passport and ID photos: rules differ between countries and authorities. We do not guarantee that a generated photo will be accepted for any official document. Always check the current requirements of the issuing authority before you submit a photo.

5. Subscriptions & Payments

• This app requires a subscription to create headshots:
• Payments are processed securely via Apple App Store.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You can manage or cancel your subscription in your App Store account settings.
• Refunds are subject to Apple’s policies.

6. Intellectual Property

All rights, title, and interest in the Application, including trademarks, content, and code, are owned by Tunahan Aktay or its licensors. You may not use these without prior written permission.

7. User Conduct

You agree not to misuse the Application. Prohibited uses include:

• Uploading harmful, abusive, sexual, or unlawful content.
• Uploading photos of another person without their permission, or of minors without the consent of a parent or guardian.
• Using generated images to impersonate, deceive, defraud, or harass anyone, or to create fake identity documents.
• Disrupting the functionality of the Application.
• Violating applicable laws or third-party rights.

We reserve the right to impose restrictions in cases of abnormal or abusive usage (e.g., nonstop automated photo submissions intended to overload the system).

8. Disclaimer of Warranties

The Application is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free service, or that every result will match your expectations or look exactly like you. If you use the Application outside of a Wi-Fi area, your mobile provider’s terms still apply and you may incur data or roaming charges. It is your responsibility to manage these costs.

9. Limitation of Liability

To the maximum extent permitted by law, FOTU shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, or the rejection of a photo by any authority or third party, arising from your use of the Application.

10. Termination

We may suspend or terminate your access to the Application at any time if you violate these Terms. Upon termination, you must cease using and delete the Application.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Türkiye, without regard to conflict of law principles. Any disputes shall be resolved in the courts of İstanbul, Türkiye.

12. Changes to Terms

We may update these Terms of Use from time to time. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of the Application after changes means you accept the new Terms.
